What is a serious medical condition?
A serious medical condition is a physical impairment that can be permanent or temporary in nature. A serious medical condition will most likely require ongoing medical treatment or the condition could become progressively worse with time.
What is a disability?
A disability is a mental or physical incapacity that results from a serious illness or an injury.
When is a person classified as disabled?
A person is considered disabled when he/she 1) has a physical or mental impairment that greatly alters his/her ability to partake in major life activities, 2) has a record of disability/impairment, and 3) is regarded as being disabled/impaired.
What is disability discrimination?
Disability discrimination is a form of bias that is directed toward people who have disabilities, serious medical conditions, or who are handicapped. Disability discrimination occurs in a work environment when an employer has bias toward a person with a disability during the job application, hiring, firing, or advancement process.
What is the ADA (Americans with Disabilities Act?
In 1990, legislature passed the ADA to protect individuals with disabilities from being discriminated against in the workforce. According to the Americans with Disabilities Act, employers are prohibited from “discriminating against qualified individuals with disabilities in job application procedures, hiring, firing, advancement, compensation, job training, and other terms, conditions, and privileges of employment.” This Act applies to all types of employers, including: private employers, state government, local government, labor unions, and employment agencies.
